Default The CMP and Delayed background checks

I am posting this to help anyone else out that gets in the same boat I was. luckily the south store staff where helpful with my issue so I wanted to let others know how to handle this.

I have a common name for the area I live in, I am one of 7 in fact, 5 of which are felons..... This often causes me to get delayed on NICS background checks, usually only for a couple hours, but it happens frequently enough I just accept it.

Last Thursday I went to the South Store and selected three rifles, knowing before hand that my paperwork was good with the CMP, having checked in advance. I put my selection in the window, did my purchase paperwork, and gave them my credit card. Normally what happens next is after a little bit they come out and give you your rifle to go, or you sign a receipt (after you show them a plane ticket) and they ship them to your house.

This did not go so well for me. I went on delay. They informed me of this and I chose to sit for two hours to see if I came off, thinking I had to sign that receipt to have them mailed.

What I later learned, when I talked to them again, is that if you are delayed, and you have provided payment like a credit card, and they are shipping them, you do not have to stay around after that, which is VERY handy. They held onto my rifles for THREE days for me while I was on delay. Then, and only after I came off delay, they charged my credit card and overnight the rifles to me.

So if you often go on delay, like me, don't worry, the south store is very accommodating with this issue and offer top notch service. Just make sure you double check with them on the paperwork, and you will get your rifles still in a timely manner.

Fortunately there are few in the Zvenoman family tree with felonies so I am not delayed, but I know a few who suffer like the OP :-)

The first rifles I purchased from CMP went on a week-long delay. I drove 12 hours to get there to get my hands on a beautiful SA M1D Combo, then drove back 12 hours empty handed.

I also have a common name and many felons with my name. I have problems all the time.

I also got delayed on the rifle I built at the Advanced Maintenance Class. Luckily I got off the delay in the nick of time and was able to drive home with the rifle I built.

I think the CMP have been terrific in handling delays. Great bunch of people down there!

Default I recommend an FBI Voluntary Appeal File (VAF).

I have had similar issues in the past.

A distant cousin has the same First & Last Name, Alias, Place of Birth(City & Hospital), Sex, Ethnicity and Race. IIRC 3 "Hits"=Delayed.

A few years ago a transfer was DENIED.

I went through the NICS Appeals Process(where outside a court room...you are allowed the opportunity to prove your innocence). After several months of jumping thru hoops and doing the FBI's job for them(You have to obtain any documents the FBI requests/needs to clear your name. Also, these documents must be certified and sent directly to the FBI=$$$). Finally, I took my Appeal Certificate to my LGS and filled-out yet another 4473 and they had to make one more call to NICS(as directed on the Certificate). So Finally after several months I was allowed to take home my new .308 Remington 700.

After all this I decided to apply for a FBI Voluntary Appeal File (VAF) and be issued a UPIN(See Box 9 on 4473).

I have had several Local Gun Store employees(Not CMP) question me(even had one tell me that the boss said I need to leave box 9 blank) about the UPIN.

I have not been even Delayed since receiving the UPIN.

If you have a common name and place of birth, that is the only way to go. My delays are always while they try to figure out what the abbreviation is for Guam is. I think I have trained all the FDLE NICS employees on it.

I think you can get a Pin number from the BATF and use that when you purchase to avoid a delay now.
