If I squeeze the band together lightly it rebounds but moderate pressure bends it closed. The screw is also odd with vertical lines on the head and the threads look in poor condition compared to the rest of the band.

Swivel is stamped replacement/Repro.... Rough machining on screw head.
Can you see any sign of metal finish wear on that band... the inside ?
Where the barrel band spring would rub inside, until it locks in place?
1-Where the swivel barrel would rub on the bands side and on the stock ?
2- Under the inside outer edges where they would contact/tighten down on the stocks barrel nose?
3- Any finish wear under the top lip that fits over your HG edge?

No metal or finish wear. I think your gut has answered for you.
I could be wrong...... but I don't think so this time.

Good luck

Pics are Decent examples of Metal/finish contact wear points on a MR band:
