Default NDAA Goes to the POTUS to be Signed! (11/16/17)

Latest on the NDAA (as of 11/17/2017)...

The changes the House made to H.R. 2810 were officially signed off on by the Senate. The bill is now headed to the POTUS to be signed into law.

Brief summary:

- Minimum of 8,000, maximum of 10,000 M1911s (including A1s) shall be transferred to the CMP in 2018 (2019 TBD, but not more than 10,000).

- Report to be compiled related to finances of the project and crimes committed with the guns.

I'm a little let down that they reinstated the "max" (if I'm not mistaken, one version had removed it). So I can only assume there will be very low and very strict purchase limits put in place. Hopefully the program will go well and be expanded in subsequent years. Unfortunately I doubt the next congress (I'm assuming a party flip) will be as willing to pass gun-related sections of bills...

Assuming no line-item veto from POTUS, this is what we have to look forward to:

(Direct quote from the finalized bill)

"Sect. 1091.Transfer of surplus firearms to Corporation for the Promotion of Rifle Practice and Firearms Safety
(a)Transfer requirement
(1)In general
During fiscal years 2018 and 2019, the Secretary of the Army shall transfer surplus caliber .45 M1911/M1911A1 pistols described in paragraph (2) to the Corporation for the Promotion of Rifle Practice and Firearms Safety in accordance with this section.

(2)Pistols described
The pistols described in this paragraph are surplus caliber .45 M1911/M1911A1 pistols and spare parts and related accessories for those pistols that, on the date of the enactment of this section, are under the control of the Secretary and are surplus to the requirements of the Department of the Army.

(3)Number to be transferred
(A)Total number
For any fiscal year, a total of not more than 10,000 surplus caliber .45 M1911/M1911A1 pistols may be transferred to the Corporation under this section and section 40728 of title 36, United States Code.

(B)Fiscal year 2018
For fiscal year 2018, not less than 8,000 surplus caliber .45 M1911/M1911A1 pistols shall be transferred to the Corporation pursuant to this section.

(4)Terms of transfers
Subsections (b), (c), (d), (e), and (g) of section 40728 of title 36, United States Code, shall apply to a transfer under this section in the same manner such subsections apply to transfers of firearms under such section 40728.

(5)Other requirements
Except as provided in subsection (b)(1), subchapter II of chapter 407 of title 36, United States Code, shall apply with respect to firearms transferred under this section.

(b)Suspension of discretionary transfer authority
(1)In general
During the period described in paragraph (2), the Secretary of the Army may only transfer surplus caliber .45 M1911/M1911A1 pistols to the Corporation under the authority of this section and may not transfer such pistols to such Corporation under section 40728 of title 36, United States Code.

(2)Period described
The period described in this paragraph is the period beginning on the date of the enactment of this Act and ending on the earlier of the following dates:

(A)The date that is 60 days after the date of the enactment of the National Defense Authorization Act for Fiscal Year 2020.
(B)June 1, 2020.
(c)Conforming repeal of pilot program for transfer of pistols
Section 1087 of the National Defense Authorization Act for Fiscal Year 2016 (Public Law 114–92; 129 Stat. 1012) is amended by striking subsections (b) and (c).

(d)Reports on transfers
(1)In general
For each fiscal year during which the Secretary transfers surplus caliber .45 M1911/M1911A1 pistols under subsection (a), the Secretary shall submit to Congress a report detailing the transfer and sale of such pistols during such fiscal year. A report under this paragraph for a fiscal year shall be submitted not later than 5 days after the budget of the President for the subsequent fiscal year is submitted to Congress under section 1105 of title 31, United States Code.

(2)Contents of report
Each report submitted under paragraph (1) shall include, for the fiscal year covered by the report—

(A)the number of surplus caliber .45 M1911/M1911A1 pistols transferred to the Corporation under subsection (a);
(B)the number of such pistols sold by the Corporation; and
(C)to the extent feasible based on the information available to the Secretary, information on any crimes committed using any such pistols transferred to or sold by the Corporation.
(e)Evaluation of corporation
(1)In general
Not later than 30 days after the date of the enactment of this Act, the Secretary of the Army shall enter into an agreement with a Federally funded research and development center with relevant expertise to conduct an evaluation of the Corporation for the Promotion for Rifle Practice and Firearms Safety for the purpose of assessing future transfers of excess firearms to the Corporation.

(2)Elements
The evaluation required under paragraph (1) shall include the following elements:

(A)An assessment of the effectiveness of the Civilian Marksmanship Program, including an examination of the functions and activities of the Program, as described in section 40722 of title 36, United States Code, that support the mission of the Program.
(B)A comparison the Civilian Marksmanship Program to similar organizations that offer instruction in marksmanship, firearm practice and safety, and opportunities for marksmanship competitions.
(C) An evaluation of benefits the Army receives from the Civilian Marksmanship Program relative to the resources the Army provides to the Program.
(D)An assessment of present and prospective funding models to support a transition to self-sustainment, including opportunities for non-Federal resources.
(E)An assessment of the costs and profits associated with the transfer of excess firearms from the Army to the Civilian Marksmanship Program (including the costs associated with the storage, inspection, and, refurbishment of such firearms), which shall be determined with respect to surplus caliber .45 M1911/M1911A pistols using data from a minimum of 8,000 sales transactions.
(F)Any other matters the Secretary determines appropriate.
(3)Report to Congress
The Secretary shall submit to the congressional defense committees a report on the results of the evaluation by not later than January 1, 2019, and shall provide interim briefings upon request.

(f)Comptroller general reviews
(1)Concurrent review of Corportion
(A)In general
At the same time as the Federally funded research and development center conducts the evaluation under subsection (d), the Comptroller General shall conduct a review of the Corporation for the Promotion for Rifle Practice and Firearms Safety.

(B)Elements
The review required under paragraph (1) shall include the following elements:

(i)A review of whether the procedures relating to sales of surplus caliber .45 M1911/M1911A pistols covered by the evaluation were conducted in accordance with applicable Federal laws.
(ii)A review of the business operations of the Civilian Marksmanship Program in comparison to the business operations of other Federally chartered organizations.
(iii)An evaluation of any authorities or agreements governing the relationship between the Army and the Program.
(iv)An assessment of the financial operations of the Civilian Marksmanship Program, including how the Program’s endowment is funded by the proceeds from sales of excess weapons transferred to the Program from the Army.
(v)An assessment of the costs and profits associated with the transfer of excess firearms from the Army to the Civilian Marksmanship Program, which shall be determined with respect to surplus caliber .45 M1911/M1911A1 pistols using data from a minimum of 8,000 sales transactions.
(vi)Any other matters the Comptroller General determines are relevant.
(C)Report to Congress
The Comptroller General shall submit to the congressional defense committees a report on the review required by subparagraph (A) by not later than January 1, 2019.

(2)Review of FFRDC report
(A)In general
The Comptroller General shall conduct a review of the report submitted under subsection (d)(3).

(B)Briefing
Not later than 60 days after the Secretary of the Army submits the report required under subsection (d)(3), the Comptroller General shall provide to the congressional defense committees a briefing on the preliminary results of the review required by paragraph (1).

(C)Report
Not later than 120 days after the Secretary submits such report, the Comptroller General shall submit to the congressional defense committees a report containing the findings and recommendations of the Comptroller General pursuant to the review required by paragraph (1)."

Thank you dangles. This bodes very well for the immediate future. It also may mean further releases in the intermediate future as well? And possibly it could mean all sorts of neat stuff becoming available while the POTUS remains in office?

Devil is in the details. I don't like the "evaluation of the corporation" or the fact that is sunsets after only two years.

My first reading of this was no way re all the reports and evaluations. But on further reading and thinking about what it seems to be saying the govt will be evaluating and reviewing any further transfers to the CMP and not it's total financial well being. Albeit they will get into the endowment funding it seems it's only to make sure the govt is seeing the CMP is doing what it says it is doing per it's Charter. If it doesn't like what it sees it can stop anymore transfers. Keep in mind the CMP has over $200mm in net assets as of its 2013 in it's Form 990 filing.

Line item veto power for the President does not exist, so this is not even a point of concern.

The so called evolution and "sunsets" are of concern, as well as the reports from the Secretary "to the extent feasible based on the information available to the Secretary, information on any crimes committed using any such pistols transferred to or sold by the Corporation."

Remember, the Secretary is a political appointee and he is going to report whatever his boss, the President, wants to hear.

While this is not as good as it should be, nor even as good as it could be, at least it is something positive. How long it lasts is anyone's guess.

Not that I've noticed. It's hard to say what the eventual CMP release will do to USGI 1911 prices but honestly, I don't expect it to have much of a downward impact. Reason is, you basically have three types of USGI 1911s available: 1) original condition, 2) true arsenal rebuilds, and 3) mixmasters of unknown origin but all GI.

The first group is expensive and will remain so because any similar nice stuff the CMP finds will likely go to auction where it will bring higher than street prices (if their other auctions are any indicator).

The third group is worth what someone will pay and that probably won't change. Maybe guns in this group will go down a little because they won't have the CMP paperwork, or maybe they'll go up because people will be looking for a source of GI parts to correct their CMP guns.

Now the second group is what the CMP will be selling. So in theory, existing arsenal rebuilds without CMP paper might be worth less with 10,000-20,000 papered guns hitting the streets. Then again, buyers might be limited to 1 CMP 1911 per year or something similar so will that really do much to offset the demand? Not sure.

If I had to guess - and a guess is all it is - I'd expect the CMP release to spur an increase in interest in GI 1911s and cause a bigger strain on the limited supply of GI parts which might actually drive prices up even higher. But maybe the reverse will be true and any non-papered mixmaster will be less desirable and will come down in price. Who knows...

Thanks, MTC. It's been quite a while now since I've taken any government classes

Re: the rest, well said. It's definitely designed as a "beta" program. The future of the program will likely be entirely dependent on the political climate.
